- Information regarding prizes and how to enter forms part of these conditions. By entering, entrants accept these conditions.
- Entry is open only to Australian residents aged 18 or over who are able to take the prize to coincide with the 2011 Toyota AFL Grand Final on 01/10/11 (exact dates to be confirmed by the Promoter) except directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter, of the participating outlets, or of the agencies or companies associated with this competition.
- The competition begins at 9am (AEST) on 22/08/11 and closes at 10pm (AEST) on 25/09/11 (Competition Period).
- During the Competition Period, this promotion will only be conducted at participating convenience outlets and select stadium outlets (Outlet). This promotion will not be conducted at supermarkets.
- To enter, consumers must, during the Competition Period, purchase any ready to eat Four’N Twenty product (Eligible Purchase) from any Outlet and either:
(a) visit www.fourntwentypromos.com.au (Website) and fully complete and submit the online entry form, by providing their full name, address, telephone number, email address, the last 5 digits of the purchased product barcode or 5 digit code from the tear-away pad found in Outlet, and any additional information as required by the Promoter. Consumers are responsible for their own costs associated with accessing the Internet; or
(b) send an SMS (maximum cost 55 cents (inc GST)) from their mobile phone to 1995 5225 stating in one message, and in the following order, the last 5 digits of the purchased product barcode or 5 digit code from the tear-away pad found in Outlet, their full name and postcode (errors and omissions excepted in the Promoter’s discretion). Computer generated SMS entries will not be accepted.
- Each entrant will receive a return online notification or SMS (at no additional cost to the entrant) (depending on their method of entry) confirming their successful entry into the competition. By entering this competition, entrants consent to receiving this electronic message.
- SMS entry is only open to consumers with an SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. Consumers should check with their network service provider to see if their mobile phone is compatible. SMS service provider is Prime Focus, SMS queries: 1800 818 957.
- All entries must be received by the Promoter during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. Entrants may enter up to 4 times per person per day provided that each entry is based on a separate Eligible Purchase. Entrants must retain their original itemised receipt to verify each entry together with the Eligible Purchase packaging (if the last 5 digits of the purchased product barcode are used to enter) or the original page from the tear-away pad showing the 5 digit code. Failure to provide this/these (without alteration) to the Promoter upon request may, at the Promoter’s discretion, result in an invalid entry (and, at the Promoter’s discretion, in all of the entrant’s entries being invalid). The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple phone numbers or aliases may be disqualified. In the event of a dispute regarding a prize awarded to an SMS entrant, the prize will be awarded to the owner of the relevant mobile phone number.
- A draw will be conducted at 12 midday (AEST) on 26/09/11 at Prime Focus, 403/62 Beach Street, Port Melbourne VIC 3207. The first valid entry randomly drawn from all entries received will win the prize.
- The prize is a trip for the winner and 5 companions aged over 18 to Melbourne to attend the 2011 Toyota AFL Grand Final on 01/10/11 at the MCG including 6 return economy airfares (including airfare taxes) from the winner’s nearest Australian capital city to Melbourne, Victoria (flights not included for VIC winner), 2 nights twin share accommodation on 30/09/11 and 01/10/11 at a minimum 3 star hotel in Melbourne (as selected by the Promoter), and 6 tickets for the winner and their companions to Four’N Twenty’s Corporate Box at the MCG to attend the 2011 Toyota AFL Grand Final on 01/10/11 including food and beverages, a mystery AFL personality to meet and greet the winner and a Sherrin football signed by members of the 2011 Four’N Twenty AFL All Australian team. The prize is valued at up to $16,000 (inc GST), depending on the winner’s place of residence.
- Flights and accommodation are subject to booking and availability. The prize must be taken to coincide with the 2011 Toyota AFL Grand Final on 01/10/11 as specified by the Promoter. All other costs associated with the prize, including but not limited to any additional meals, transfer costs, taxes, insurance, spending money and other ancillary costs are the responsibility of the winner and their companion, as incurred. All elements of the prize are subject to any additional terms and conditions specified by the prize supplier/s.
- The winner’s name and state/territory of residence will be published on the Website as soon as the winner is drawn and in the case of any Victorian winner, in The Australian on 27/09/11.
- The winner will be notified by phone and in writing.
- If a prize is not accepted or claimed by 11am (AEST) on 28/09/11 the relevant winner’s entry will be deemed invalid and the Promoter will conduct such further draws at 12.00 midday (AEST) on 28/09/11 at the same location as the original draw as necessary to distribute the prize. Any winner in this draw will be notified in writing and by phone and will have their name and state/territory of residence published on the Website as soon as the winner is drawn and in the case of any Victorian winner, in The Australian on 29/09/11.
- The Promoter and/or Outlet may require entrants to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s/Outlet’s discretion.
- The winner and their companions must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
- If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of the prize will be determined by drawing a further valid entry in accordance with paragraph 9.
- The judges’ decision is final and no correspondence will be entered into.
- If the 2011 Toyota AFL Grand Final on 01/10/11 is abandoned, called off or postponed for any reason, the winner forfeits all rights to attend the 2011 Toyota AFL Grand Final and no cash or alternative tickets will be substituted in lieu. The winner will still receive all other components of the prize including the accommodation and flights provided that such prizes must still be taken on the original trip dates as specified by the Promoter.
- The Promoter will not be liable for the failure of the mystery AFL personality to attend the 2011 Toyota AFL Grand Final on 01/10/11, for whatever reason.
- The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
- Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
- The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person. The Promoter may in its absolute discretion prohibit an entrant’s participation in this competition, cancel the prize or otherwise cease to provide any benefit of the prize to a winner and their companions if the winner (or any of their companions), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this promotion, is contrary to law or is otherwise inappropriate.
- Prizes are not transferable or exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If for any reason the winner or any of their companions do not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. If the prize or an element of the prize is unavailable for any reason the Promoter may substitute for that prize or that element another item of equal or higher value as determined by the Promoter.
- If for any reason any aspect of this competition is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory if required.
- The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where the operation of this competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
- All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this promotion, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotion and marketing purposes regarding its products, including contacting the entrant via electronic messaging. By entering this competition, entrants consent to receiving SMS or email messages from the Promoter. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
